Hazardous Waste Manifest Rule

On March 4, 2005, the U.S. Environmental Protection Agency (EPA) published a Final Hazardous Waste Manifest System Rule. The Rule establishes a standard manifest form and changes existing RCRA manifest system requirements. The changes are designed to streamline and improve hazardous waste tracking, record-keeping, and reporting. TRI Forms Modified 

On July 12, 2005, EPA published a final rule modifying TRI forms R and A, “to improve reporting efficiency and effectiveness, reduce burden, and promote data reliability and consistency across Agency programs.”  The rule is effective September 12, 2005, and will be in effect for the July 1, 2006, reports.  The rule removes some data elements from the certification statement (facility identification and location data) that can be obtained from other data collected by EPA.

Amendment to MACT General Provisions on Part 2 Applications  

On July 11, 2005, EPA published a final rule amending table 1 to 40 CFR Part 63, subpart B.  The amendment changes the date required for submitting CAA Section 112(j) Part 2 permit applications for boilers and hydrochloric acid production furnaces that burn hazardous waste.  The date is changed from August 13, 2005, to November 14, 2005, based on an amended consent decree.

Proposed NSPS for Stationary Diesel Engines 

On July 11, 2005, EPA published proposed new source performance standards (NSPS) for stationary compression ignition internal combustion (diesel) engines, under section 111(b) of the Clean Air Act.   The proposal would require all new, modified, and reconstructed stationary diesel engines to use the best demonstrated system of continuous emission reduction, considering costs, non-air quality health, and environmental and energy impacts.  Controls would be required for the reduction of NOx, PM, HC, and CO.  Sulfur dioxide reductions would be achieved by the requirement to use diesel fuel with a maximum sulfur content of 500 ppm by October 1, 2007, and 15 ppm by October 1, 2010.

EPA to Conduct SPCC Workshop at Environmental Conference 

Registration is open for the NPRA Environmental Conference in Dallas September 18-20.  After the Newsreel on the afternoon of September 20, EPA will offer a workshop on Spill Prevention, Control and Countermeasure (SPCC), focusing primarily on bulk storage facilities.
